Minister Tabbi explained during a public session in the National Assembly, on Tuesday, devoted to presenting and discussing a text related to the protection and preservation of state lands, that this is with the aim of “determining the mechanisms for protecting state lands from seizure, the rules applied to buildings and facilities built on them illegally, and the penalties applied in the event of infringement.” on her”.
The same minister indicated that this text can be divided into “three basic axes related to strengthening precautionary measures to protect state lands, combating chaotic buildings and strengthening criminal protection,” “in implementation of the instructions of the President of the Republic, Abdelmadjid Tebboune, which include preparing a legal text to protect state lands, after… The phenomenon of attacks on these lands has witnessed a significant increase in recent years.”
The minister himself confirmed that he intended to protect lands belonging to national property, as the text of the law “grants the managers of state lands the right to resort to the competent judge to take every action or measure necessary to protect them. The competent state interests, local groups, institutions and public bodies concerned also follow up on the implementation of judicial rulings issued in the field of Protecting state lands and ensuring their return to their original state.”
The Minister of Justice stressed, “It is not possible to construct buildings or facilities on state lands except after obtaining licenses issued by the competent administrative authorities and demolishing buildings or facilities that are constructed illegally on state lands by an official decision.”
The government representative revealed that the text “specifies the procedural rules that are compatible with the effective fight against crimes occurring on the state’s territory by identifying qualified agents to search for and inspect the crimes stipulated in this project, in addition to the investigations they deem necessary and requesting that they be informed of the technical documents related to them.”
The text criminalizes “all forms of infringement occurring on state lands relevant to its field of application and provides for them penalties of deprivation of liberty, which may reach imprisonment for a period of 15 years and a fine that may reach 1,500,000 Algerian dinars depending on the seriousness of the act committed and the character of the perpetrator, and increases the penalty if the infringement leads to action.” On the territory of the state or if it results from inaction or leniency or the moral partner and instigator.”
