This is what the Minister of Justice said about the draft Penal Code – New Algeria
The Minister of Justice, Keeper of the Seals, Mr. Abdelrachid Tabbi, explained today, Monday in Algiers, that the draft penal code presented to Parliament Comprehensive and up to date with all developments.

In his response to the Council members’ interventions regarding some of the provisions contained in the law, such as those related to: With alternative penaltiesThe minister pointed out that the judge pronounces it in the presence of the convict and requires his approval to replace the custodial sentence with an alternative punishment, highlighting that this type of punishment is a system in place globally and Algeria must not remain far from the new systems.
Regarding the immediate arrest of an employee or elected person who is subject to criminal prosecution, the Minister of Justice pointed out that there are other laws that govern it, such as the municipal laws andpublic employment.
Regarding uttering indecent expressions in public places, the Minister added that proving this crime comes through reporting to initiate a public lawsuit, and it does not require the presence of an injured party.
When referring to the criminalization of some acts and the removal of their criminal character, the Minister of Justice explained that these provisions aim to relieve pressure on the criminal courts, announcing, by the way, that there will soon be a move towards collective justice in the courts, to guarantee the rights of litigants.

In their interventions, most members appreciated the text of the law keeping pace with technological development in light of the emergence of cybercrime, in addition to enhancing the state’s prestige and providing protection for security personnel, professors, and imams, as well as replacing the spoken ruling with alternative punishments, adding new forms of crime such as sorcery, insulting symbols of the revolution, and imposing penalties against those who utter indecent expressions.
As for the report of the Council’s Legal and Administrative Affairs, Human Rights, Local Organization, Territory Development and Territorial Division Committee report, which was presented by Mr. Mohamed Salmi, it confirmed that the amendments made to the text of the law are of great importance in terms of strengthening the protection of security wires, combating various forms of crime, and ensuring the protection of citizens in public spaces. And the morals of public life and the safety of public property, noting that the importance of these amendments is to criminalize them to obstruct investment and protect managers and investors in implementation of the obligations of the President of the Republic.
For reference, this legal text is divided into 8 axes, related to reviewing provisions related to some criminal cases, strengthening the protection of managers and supporting investment, enhancing the protection of victims of some crimes, including organized criminal groups, criminalizing new acts, strengthening the protection of security services, alternative penalties and various provisions.
