The Ministry of Commerce: Monitoring product conformity is an exclusive task with legally qualified agents

The Ministry of Commerce and Export Promotion confirmed, in a statement today, Thursday, that the control of product conformity is an exclusive task for legally qualified agents, headed by agents for the suppression of fraud, noting that the self-control laboratories of industrial establishments cannot undertake the control of conformity of other products.
The statement stated: “The Ministry of Commerce and Export Promotion brings to the knowledge of all economic operators and activists in the field of consumer protection that, according to the provisions of Article 25 of Law No. To search and examine the violations stipulated in this law, they are the fraud suppression agents of the Ministry of Commerce and Export Promotion, in addition to the judicial police officers and the agents authorized under their respective texts.
The Ministry stated that these agents are qualified to monitor the conformity of products at all stages of the production, import and distribution processes, by adopting control by examining documents and/or hearing the concerned interlocutors, or through direct inspections with the naked eye or with measuring devices.
It is also possible, according to the same source, to resort to deducting samples for the purpose of conducting analyses, tests or experiments.
In this context, the Ministry reminded all economic operators that “taking samples in order to monitor product conformity is an exclusive task for legally qualified agents, and that laboratories affiliated with the Ministry of Trade and Export Promotion are authorized to conduct analyses, tests and experiments within the framework of consumer protection and fraud suppression.”
As for the self-control laboratories of industrial establishments, the statement emphasized that “their tasks are limited to carrying out analyses, tests and experiments on manufactured products, within the framework of mandatory self-control stipulated in the provisions of Article 12 of Law No. 09-03 mentioned above,” pointing out that “It cannot undertake the control of conformity of other products, which remains the competence of legally qualified services.”
