In his response to a written question from parliamentary representative Ahmed Belalem, Belabed specified how to exploit the “reserve lists” for the rank of primary school principal in general and at the level of the state of Adrar in particular, in order to remove confusion and raise suspicion about the same file, and thus apply a legal rule with a unified content, to avoid… For interpretations and “legal confusion” between the various interests of employees in the state education directorates.
The Minister continued in his response that the competent departments of the education directorates of the states are authorized to resort to exploiting the reserve lists for administrative ranks, exceptionally and rationally at the same time, in order to cover the vacant financial positions that are finally and effectively released, during the period extending between two competitions, two examinations, or two professional examinations, for anyone. The following reasons: retirement, transfer, referral to national service status, discharge, dismissal, resignation, and death.
Belabed stood, in order to achieve the desired goal of the operation, which is to meet the necessary needs of public institutions and administrations for employees in general, and not to leave educational institutions in the three educational stages, without administrative supervision in particular, stressing in this regard that the “reserve lists” do not fall. It thus remains valid until the opening of the competition, examination, or professional examination for the following fiscal year, and at the latest until the closing date of the following fiscal year.
From the above, the Minister said that the process of exploiting reserve lists for professional competitions and examinations is governed by legal texts, especially Article 28 of Executive Decree No. 12-194 of April 25, 2012, which specifies how competitions, examinations and professional examinations in public institutions and administrations are organized and conducted, indicating that Article 5 thereof stipulates the necessity of maintaining financial positions distributed among the various types of employment and basic legal promotion for a period of 12 months after the end of the relevant fiscal year.
Belabed noted that Instruction No. 01 dated February 20, 2013, issued by the General Directorate of Public Service and Administrative Reform, related to the implementation of the aforementioned executive decree, had carefully detailed the procedures for preparing reserve lists and their powers, as it stated that it was intended to allow public institutions and administrations to replace… Candidates who have finally succeeded in competitions, examinations and professional examinations, and who have not yet joined their appointed positions, within a period of one month, as stipulated in Article 31 of Executive Decree No. 12-194 of April 25, 2012, referred to previously, the final admission committees shall thus undertake the task of Preparing reserve lists according to the degree of entitlement, by relying on what is known as the “differential order”, that is, descending upward from the highest rate until reaching the lowest rate, provided that the number of vacant and permanently released financial positions is adhered to.
The Minister stressed that some ranks are subject to training, including, but not limited to, secondary school principal, middle school principal, and assistant principal of a primary school, whose reserve lists are excluded once the sectoral supplementary training plan is studied and approved by the interests of the General Directorate of the relevant public service. Its content is implemented immediately upon launching the specialized training.
The Minister indicated that it is not possible to make any amendment to the plan after that, and it is not possible to resort to exploiting the reserve lists for those administrative ranks, except in the event that a competition is not held in the following year, noting that the reserve lists are activated every year and this is according to the regulation in effect.
